COMMISSION PRESENTATIONS AND ANNOUNCEMENTS

 

1.         Presentation from Mayor Harvey regarding the County Commission’s recently adopted resolution supporting of the City of Brunswick’s initiative to invoke redevelopment powers.

 

PUBLIC HEARING – Alcoholic Beverage License

 

2.         Consider approval of a transfer of the 2014 license and the renewal of a 2015 alcoholic beverage license for Logan’s Roadhouse #528, 101 Capital Square Drive, Brunswick, Ga.  The license is to sell distilled spirits, malt beverages and wine for consumption on premises of a restaurant.  Sunday Sales permitted.  Peter Nodzak, licensee. (Occupation Tax/Chief Doering) REPORT

 

Peter Nodzak, licensee, was present at the meeting as required by ordinance. Police Chief Matt Doering said the applicant met the requirements for consideration of issuance of the license. This item was opened for public comment, yet no one addressed the Board.

 

A motion was made by Commissioner Strickland and seconded by Commissioner Hunt to approve the issuance of a 2014 alcoholic beverage license and the renewal of a 2015 license for Logan’s Roadhouse #528. The motion carried unanimously.

A motion was made by Commissioner Taylor and seconded by Commissioner Booker to approve the transfer of a 2014 alcoholic beverage license and the renewal of a 2015 license for Brunswick Truck Stop. The motion carried unanimously.

 

4.         Consider the issuance of a new 2015 alcoholic beverage license for Jack Rabbit, 4902 Highway 17 N, Brunswick, Ga.  The license is to sell malt beverages and wine not for consumption on premises of a convenience store.  Sunday Sales permitted. A motion was made by Commissioner Taylor and seconded by Commissioner Hunt to approve the transfer of the 2015 alcoholic beverage license for Denny’s #7845. The motion carried unanimously.

A motion was made by Commissioner Hunt and seconded by Commissioner Strickland to approve the issuance of a 2015 alcoholic beverage license for Mulligan’s. The motion carried unanimously.

 

7.         Consider approval of a transfer of the 2014 license and the renewal of a 2015 alcoholic beverage license for Applebee’s Neighborhood Grill & Bar, 177 Altama Avenue, Brunswick, Ga.  The license is to sell distilled spirits, malt beverages and wine for consumption on premises of a convenience store.  Sunday Sales permitted.  Kimberly Elam, licensee. (Occupation Tax/Chief Doering) REPORT

 

Kimberly Elam, licensee, was present at the meeting as required by ordinance. Police Chief Matt Doering said the applicant met the requirements for consideration of issuance of the license. This item was opened for public comment, yet no one addressed the Board.

 

A motion was made by Commissioner Strickland and seconded by Commissioner Taylor to approve the transfer of the 2014 license and the renewal of a 2015 license for Applebee’s Neighborhood Bar & Grill. The motion carried unanimously.

A motion was made by Commissioner Strickland and seconded by Commissioner Hunt to approve the renewal of the 2015 alcoholic beverage licenses to the applicants listed above. The motion carried unanimously.

 

CONSENT AGENDA – General Business

 

9.         Approved the minutes of the special called meetings held September 16, 2014, October 21, 2014, and December 4, 2014, as well as the minutes of the regular meeting held December 4, 2014, subject to any necessary corrections.  (C. Overstreet)

 

10.       Approved the overhead easement and underground easement for Georgia Power to install electrical lines at the Public Works Compound. (D. Austin) REPORT

 

11.       Authorized the Chairman of the Board of Commissioners or the County Administrator to file grant applications on behalf of the Board of Commissioners. (D. Hainley) REPORT

 

12.       Approved defining the right-of-way along Demere Road (formerly known as Airport Road) by approving the survey plats prepared by Shupe Surveying Company on September 16, 2014. Adoption of these plats would assist in establishing the setbacks for the Glynn County Airport Commission and St. Simons McKinnon Airport. (D. Hainley) REPORT

A motion was made by Commissioner Hunt and seconded by Commissioner Taylor to defer this item to the Board’s March 5, 2015, meeting. The motion failed for lack of majority vote of 3-4 with Commissioners Provenzano, Strickland, Booker, and Coleman opposed.

 

A motion was made by Commissioner Strickland and seconded by Commissioner Coleman to leave the $21,589 in the SPLOST 4 SSI Sports Complex Improvements Project line item. The motion carried unanimously.

 

40.       Consider approving the second year option for Fire Department employees Wellness Physicals to Southeast Georgia Health System of Brunswick, GA., with funding from the General Fund and Fire Fund of the Fire Department. (P. Nicometo) This item was referred to the Board of Commissioners without a recommendation from the Finance Committee. REPORT

 

A motion was made by Commissioner Coleman and seconded by Commissioner Booker to approve the second year option of the contract with Southeast Georgia Health System of Brunswick, GA to provide Wellness Physicals for Fire Department employees engaged in fire suppression, investigation and prevention, and emergency medical services in the amount of $235 per physical, with funding from the General and Fire Fund of the Fire Department. The motion carried 6-0-1 with Commissioner Hunt abstaining.

 

41.       Consider adoption of a resolution recommending passage of amendments to the Brunswick-Glynn County Joint Water and Sewer Commission Act of 2006, as amended.  Adoption of this resolution is being requested by the Brunswick-Glynn County Joint Water and Sewer Commission (JWSC). REPORT

 

Desiree Watson, attorney for the JWSC, highlighted the proposed changes to the JWSC act. Those changes included: changing the name of the commission to Brunswick-Glynn County Water and Sewer Commission; changing the process for making appointments to the JWSC to allow for 4-year terms instead of three; creating nonpartisan elections to be held in conjunction with the general primary election; establishing a quorum as being four members; allowing for the solicitation of donations for certain residential customers; and providing the JWSC the power to condemn private property for public infrastructure purposes.

 

A motion was made by Commissioner Hunt and seconded by Commissioner Booker to approve the adoption of the resolution. The motion carried unanimously. Resolution #R-46-14

 

42.       Consider approval of the Fourth Addendum to the Operational Agreement by and among City of Brunswick and Glynn County and Brunswick-Glynn County Joint Water and Sewer Commission.  Approval of this amendment is being requested by the Brunswick-Glynn County Joint Water and Sewer Commission (JWSC). REPORT

 

Ms. Watson reported this addendum would incorporate changes that have been made since the agreement was created in 2007. The addendum removed all mention of United Water, the former water and sewer contractor, since the JWSC now performs those functions.

Also removed from the addendum were all referrals to an exhibit originally part of the 2007 agreement listing former employees of the city and county who were transferred to the JWSC when it was created. These employees were protected from termination for the first four years if no cause was shown. These employees have either moved on to other jobs or are still employed by the JWSC.

The provision of 70/30 agreements for developers has been replaced by the ability to enter into a proportionate share agreement with developers for the repayment of capital tap fees.

The original operational agreement required the JWSC to distribute copies of its annual audit and other financial and regulatory reports to the city and county. The revision allows for those reports to be made available only upon request of the city or county.

As set forth in state law, the JWSC cannot be terminated by the city and county without legislative authority or a referendum because the commission is now made up of elected officials.

Finally, if the general assembly approves amendments to the Brunswick-Glynn County Joint Water and Sewer Commission Act of 2006, as recommended by the city and county, and provides the JWSC with the authority to exercise the power of eminent domain, the sections of the operational agreement prohibiting eminent domain would be voided. 

It was explained that the use of eminent domain would be only for easements for underground water and sewer. Ms. Watson reported that all other water and sewer authorities and commissions in Georgia have the authority to condemn property for the purpose of running water and sewer lines. The purpose of the JWSC is to provide infrastructure to the public and sometimes that ability is negated because one homeowner will not allow the easements.  Commissioner Provenzano advised that all other public utilities in Georgia, including power companies, are allowed to run lines for the good of the public.  Commissioner Coleman mentioned that providing water lines for fire protection in the rural areas of the county would be appreciated by those property owners and would increase the county’s ISO rating, thus reducing insurance premiums.

 

A motion was made by Commissioner Strickland and seconded by Commissioner Coleman to approve the Fourth Addendum to the Operational Agreement. The motion carried 5-2 with Commissioner Hunt and Commissioner Browning opposed.

 

43.       Consider approval of an amendment to the Water and Sewer Ordinance by adding a Section 2-16-7.1 and revising sections 2-16-7, 2-16-8, 2-16-62, 2-16-63, and 2-16-65.  This amendment is being requested by the Brunswick-Glynn County Joint Water and Sewer Commission (JWSC). REPORT

 

The proposed ordinance amendment would allow the JWSC to offer irrigation only meters for light commercial and residential users, allow irrevocable letters of credit for ten or more accounts, requires that the issuance of Certificates of Occupancy (CO) not be issued until the JWSC’s standards are met, allows for the return of deposits for customer accounts, and allows for leak adjustments in the billing cycles.

 

A motion was made by Commissioner Coleman and seconded by Commissioner Booker to approve the amendment to the Water and Sewer Ordinance. The motion carried unanimously.  Ordinance #O-2014-06
