PUBLIC COMMENT PERIOD- No requests to speak were received during the sign up period. Therefore, no public comments were received by the Board of Commissioners during the scheduled Public Comment Period.

 

COMMISSION PRESENTATIONS AND ANNOUNCEMENTS

 

A motion was made by Commissioner Taylor and seconded by Commissioner Clark to defer item 15 to the Board’s December 20, 2012, meeting. The motion carried unanimously.

 

1.         Presentation of the Center for Digital Government’s Best of the Web Award received by the Glynn County Board of Commissioners for its website www.glynncounty.org.

 

PUBLIC HEARING – Alcoholic Beverage License

 

2.         Consider the issuance of a 2013 alcoholic beverage license to Two Way Fish Camp, 201 Charlie Gibbs Way, Brunswick, GA. The license is to sell malt beverages and wine not for consumption on premises of a convenience store.  Sunday sales permitted.  This is an addition of wine package sales to the renewal of the 2013 license.  Rick Smith, licensee (Occupation Tax/Chief Doering) LINK

 

Rick Smith, licensee, was present at the meeting as required by ordinance. Police Chief Matt Doering said the applicant met the requirements for consideration of issuance of the license.

This item was opened for public comment, yet no one addressed the Board.

 

A motion was made by Commissioner Clark and seconded by Commissioner Sublett to approve the issuance of a 2013 alcoholic beverage license to Two Way Fish Camp. The motion carried unanimously.

 

3.         Consider the issuance of a 2013 alcoholic beverage license to Mulligan’s Bar & Grill, 5250 New Jesup Hwy, Brunswick, GA. A motion was made by Commissioner Callaway and seconded by Commissioner Clark to approve the issuance of a 2013 alcoholic beverage license to Mulligan’s Bar & Grill. The motion carried unanimously.

 

4.         Consider the issuance of a 2013 alcoholic beverage license to Little St Simons Island, Little St. Simons Island, GA. A motion was made by Commissioner Sublett and seconded by Commissioner Callaway to approve the issuance of a 2013 alcoholic beverage license to Little St. Simons Island. The motion carried unanimously.

 

5.         Consider the issuance of a 2013 alcoholic beverage license to Iguanas Seafood Restaurant, 303 Mallery Street, St Simons Island, GA. A motion was made by Commissioner Taylor and seconded by Commissioner Callaway to approve the issuance of the 2013 alcoholic beverage licenses. The motion carried unanimously.

 

PUBLIC HEARING – Land Use

 

10.       ZM2449 (I) Cordell Property - Consider a request to rezone from MR (Medium Residential) to PD (Planned Development). The 1.24-acre property is located on the north side of Demere Road on St. Simons Island. The purpose of the request is to permit the uses allowed in Local Commercial zoning. The availability of public water is contingent upon the owner/developer’s successful acquisition of easements on private property needed to access public utilities facilities. Parcel ID 04-13636. The Islands Planning Commission voted to recommend denial of the application.  Staff recommended approval. When the Planning Commission’s recommendation differs from the staff’s, it becomes the Board of Commissioners’ responsibility to review the findings of fact to determine whether or not the application can be approved. The following finds of fact must be considered:

(1) Whether the zoning decision will permit a use that is suitable in view of the use and development of adjacent and nearby property.

(2) Whether the zoning decision will adversely affect the existing use and or usability of adjacent or nearby property.

(3) Whether the property to be affected by the zoning decision has a reasonable economic use as currently zoned.

(4) Whether the zoning decision will result in a use, which will or could cause an excessive or burdensome use of existing streets, transportation facilities, utilities or schools.

(5) Whether the zoning decision is in conformity with the policy and intent of the Comprehensive Land Use Plan.

(6) Whether there are other existing or changing conditions affecting the use and development of the property, which give supporting grounds for either approval or disapproval of the zoning decision.

This item was opened for public comment and Taylor Haley, agent for applicant, addressed the Board.  Dick Weiderhorn, and Roster Buchanan and Berthenia Gibson, adjacent property owners in Jewtown, spoke in opposition to the rezoning.

 

Upon review of the traffic count study, the Board determined that rezoning the property could cause an excessive or burdensome use of the existing streets.

 

A motion was made by Commissioner Sublett and seconded by Commissioner Coleman to deny ZM2449 because the property can be developed as is currently zoned and the rezoning could cause public endangerment and traffic issues as referenced in item 4 above. The motion carried unanimously.

 

11.       TA2497 – Zoning Ordinance Text Amendment - Consider an amendment to Article VI Section 607 to amend the standards and administrative practices for nonconforming uses, to permit administrative relief under certain conditions and provide clarification of a nonconforming use in Glynn County’s regulations. The proposed changes to the zoning ordinance provide clarification of a nonconforming use in the County’s regulations and an opportunity for administrative relief under certain conditions.

This item was opened for public comment, yet no one addressed the Board.

 

A motion was made by Commissioner Taylor and seconded by Commissioner Callaway to approve TA2497. The motion carried unanimously.  Ordinance #O-2012-09

 

12.       SUP2471 (M) C.B. Greer Elementary Electronic Sign - Consider a request for a Special Use Permit for the erection of an electronic variable message sign under Section 809(e) (2) of the Glynn County Zoning Ordinance. The property is located at 695 Harry Driggers Blvd. Parcel ID 03-13678. Glynn County Board of Education, owner.  LINK

 

This permit would allow construction of an electronic variable message sign in a district where such signs are not permitted. Electronic Variable Message signs are regulated under Article VIII, Signs, of the Glynn County Zoning Ordinance. Without a Special Use Permit, these signs are only permitted in Local Commercial, General Commercial, Highway Commercial, Freeway Commercial, Shopping Center Planned Commercial, Limited Industrial, Basic Industrial, and General Industrial zoning districts.

Electronic variable message signs are prohibited within 50 feet of any dwelling or residentially zoned district without Special Use approval. While the parcel in question is bordered by residential property to the north, the sign would be located approximately 230 feet from the nearest property line on the east side of the gymnasium wall and would be approximately 36 square feet in size.

The Mainland Planning Commission and staff recommended approval of this permit.  This item was opened for public comment and Anna Wiles, principal of the school, asked the Board to approve the request.

 

A motion was made by Commissioner Clark and seconded by Commissioner Coleman to approve SUP2471.  The motion carried unanimously.  Resolution #R-68-12

           

 

CONSENT AGENDA – General Business

 

13.       Approved the minutes of the regular meeting held November 15, 2012, subject to any necessary corrections.  (C. Overstreet)

 

14.       Approved an easement presented by Brunswick Cellulose at the request of Glynn County to provide a utility easement required for the construction of the new detention center and a second easement to provide for a material lay down area for the sewer line.   (D. Hainley) LINK

 

15.       Approve the easements for Georgia Power to relocate a transmission line as a part of the new detention center site development. The existing transmission line conflicts with the proposed development of this site and needs to be relocated. (D. Hainley) This item was deferred to the Board’s December 20, 2012, meeting.

 

16.       Accepted a drainage easement from The Four County Bank or Waffle House Inc. on property located at 5028 New Jesup Highway. Parcel ID 03-04165. The drainage easement is being provided to the County for drainage between two commercial properties. (D. Hainley) LINK

 

17.       Authorized Christmas Eve, Monday, December 24, 2012, as a holiday observed by the Board of Commissioners. (O. Reed) LINK

 

18.       Approved the Stipulation Regarding Disbursement of Forfeited Property received from the District Attorney’s Office for the purpose of distributing forfeited property to the District Attorney’s Office, the Georgia Bureau of Investigation, and the Glynn-Brunswick Narcotics Enforcement Team. 19.       Approved access to the Glynn County Employee Wellness Center to full-time employees not covered by the County’s health insurance plan subject to a $20 payment per visit and participation in the health risk assessment, biometric screening, and any necessary wellness coaching sessions. CONSENT AGENDA – Pension Committee

 

20.       Approved exercising the third year extension of the contract with Cavanaugh Macdonald for the provision of actuarial services (Pen Comm Vote: 7-0) LINK

 

A motion was made by Commissioner Sublett and seconded by Commissioner Taylor to approve all items on the consent agenda except item 15, which was deferred. The motion carried unanimously.

 

GENERAL BUSINESS

 

21.       Consider a request to authorize payment of water and sewer charges as a part of the detention center site development. The total charge for the project is $177,890, which represents the current overall discount plus a credit for existing usage. Funding for the project is requested to come from the General Fund fund balance. (D. Hainley) LINK

 

A motion was made by Commissioner Coleman and seconded by Commissioner Sublett to authorize payment of water and sewer charges for the new Sheriff’s Complex site. The motion carried unanimously.

 

EXECUTIVE SESSION

 

A motion was made by Commissioner Sublett and seconded by Commissioner Coleman to adjourn to executive session to discuss personnel matters.  The motion carried unanimously.

 

Back in Session

 

A motion was made by Commissioner Sublett and seconded by Commissioner Callaway to adjourn executive session and enter into regular session. The motion carried unanimously.

 

A motion was made by Commissioner Callaway and seconded by Commissioner Sublett to approve the minutes of the November 1, 2012, executive session. The motion carried unanimously.
