INVOCATION AND PLEDGE       

 

PUBLIC COMMENT PERIOD – Mary Ann Nichols signed up to speak regarding the Local Option Sales Tax (LOST) allocations. Due to a cold, Ms. Nichols opted instead

to send a letter to the commissioners.

 

COMMISSION PRESENTATIONS AND ANNOUNCEMENTS

 

1.         Proclamation recognizing John Lane for his recent induction into the Georgia Radio Hall of Fame. (M. Hunt)

 

PUBLIC HEARING – Alcoholic Beverage License

 

2.         Consider the transfer of licensee of a 2012 alcoholic beverage license to Pilot Travel Center #627, 2990 US Highway 17 S, Brunswick, GA.    The license is to sell malt beverages and wine, not for consumption on premises of a convenience store.  Sunday sales permitted.  This is a transfer of licensee of a current 2012 license.  Charles Williams, licensee (Occupation Tax/Chief Doering)  LINK

 

Charles Williams, licensee, was present at the meeting as required by ordinance. Police Chief Matt Doering said the applicant met the requirements for consideration of issuance of the license.

This item was opened for public comment, yet no one addressed the Board.

 

A motion was made by Commissioner Callaway and seconded by Commissioner Sublett to approve the issuance of a 2012 alcoholic beverage license for Pilot Travel Center #627. The motion carried unanimously.

A motion was made by Commissioner Sublett and seconded by Commissioner Hunt to approve the issuance of a 2012 alcoholic beverage license for CVS Store #4337. The motion carried unanimously.

 

PUBLIC HEARING – Land Use

 

4.         ZM2430 (M) Capital Square - Consider a request to rezone from FC (Freeway Commercial) to PD (Planned Development) and amend a PD (Planned Development) zoning text to allow a mixture of commercial and residential uses. The property is located south of Venture Drive and west of the I-95 southbound on-ramp at Exit 38. Parcel ID 03-26509, 03-03351, 03-12452. Southern Real Property Inc., owner, applicant.  (D. This property was rezoned to Planned Development (Courtney Cove) in 2007. At that time it was approved for 348 dwelling units on a 25-acre portion and a 3.8-acre portion allowing the permitted uses found in Freeway Commercial in the Zoning Ordinance.

The applicant requested an amendment to allow more flexibility. The commercial acreage would be expanded to allow a combination of FC and HC uses. The number of potential dwelling units would be reduced to a maximum of 267. A portion of this property is zoned FC currently.

Community Development Director David Hainley reported the Mainland Planning Commission and staff recommended approval of the application.

This item was opened for public comment and Cameron Owens, owner of Southern Real Property, asked for approval of the rezoning.  Selena Breitenbagh expressed concern regarding the traffic flow in the area. 

 

A motion was made by Commissioner Hunt and seconded by Commissioner Taylor to approve ZM2430 Capital Square to rezone from FC to PD and amend the PD to allow a mixture of commercial and residential uses.  The motion carried unanimously.  Resolution #R-51-12

 

5.         ZM2455 (M) Confederate Station – Consider a request to rezone from FA (Forest Agricultural) to LC (Local Commercial) a  22.417 acre portion of a 62.465 acre parcel located at 6045 Golden Isles Parkway. The purpose of the rezoning is to allow rental of a building for events on a portion of the property, and for other uses as may be approved in Local Commercial Zoning per §701.2 of the Zoning Ordinance. The building on the subject property was permitted as an accessory use to Chapman Funeral Home on November 8, 2005, but since then was altered to commercial. Al Chapman has requested to rezone the property to Local Commercial, though he has no further plan to develop the property at this time. He intends to continue the present use of renting the property for special events. He provided a survey of a 22.417-acre portion of the 62.465-acre parcel for the zoning boundary of LC (Local Commercial). The LC zoning is requested because it allows a private or semi-private club, lodge, union hall or social center.

Further development, either on the 22.417-acre portion to be rezoned, or on the remainder of the parcel, would require subdivision of the lot or lots involved at the time of development. Site plans and building plans would also be required.

The Mainland Planning Commission and staff recommended approval of this request.

This item was opened for public comment and Al Chapman asked the Board to approve the rezoning application.

 

A motion was made by Commissioner Taylor and seconded by Commissioner Sublett to approve ZM2455 Confederate Station to rezone from FA to LC the 22.417-acre property. The motion carried 4-0-1 with Commissioner Callaway abstaining.  Resolution #R-52-12

 

6.         ZM2459 (M) Planting Hammock – Consider a request to rezone by amending a PD (Planned Development) zoning text. This property was rezoned to PD (Planned Development) in 2004 from GR (General Residential), which allowed duplexes to be built.

 

The applicant requested an amendment to allow both single family residences and lots to be split and sold as two separate units. This would allow one-half of the lot to be subdivided per unit if desired. The PD text was streamlined from the 2004 version, by taking out extraneous verbiage that is no longer needed because the homeowners association is in place and the roads, utilities, and easements are conveyed. Setbacks were also revised to allow development on smaller or irregular lots.

The Mainland Planning Commission and staff recommended approval of this rezoning.

This item was opened for public comment and Bruce Garrett asked the Board to approve the rezoning application.

 

A motion was made by Commissioner Callaway and seconded by Commissioner Hunt to approve ZM2459 Planting Hammock to rezone by amending the Planned Development text to allow single family development as well as duplex development. The motion carried unanimously.  Resolution #R-53-12

 

7.         ZM2453 Zoning Map Correction 1200 Ocean Boulevard – Consider a request to make a correction to the Glynn County Zoning Map, as provided in Article XI, Section 1110. The correction involves a portion of Parcel # 04-14178 which was incorrectly depicted on the Zoning Map. The property is located at 1200 Ocean Boulevard near the southeast corner of Ocean Boulevard and Neptune Park. The property was originally zoned HC (Highway Commercial) in 1962, but is depicted on the Zoning Map as RR (Resort Residential). Parcel ID 04-14178. Glynn County Board of Commissioners, applicant.                         Agenda items 7, 8, 9, and 10 were presented together.

            Community Development Director David Hainley reported these items were map corrections, not amendments to the zoning ordinance. These errors were discovered during research of the records.

            These items were opened for public comment, yet no one addressed the Board.

 

A motion was made by Commissioner Taylor and seconded by Commissioner Callaway to approve ZM2453, ZM2465, ZM2477, and ZM2483. The motion carried unanimously.  Resolution #R-54-12

 

8.         ZM2465 Zoning Map Correction Ashantilly and Kings Way - Consider a request to make corrections to the Glynn County Zoning Map, as provided in Article XI, Section 1110. The corrections involve two parcels which are located at 193 Ashantilly and 205 Kings Way on St Simons Island. The Zoning Map incorrectly shows both parcels as having no zoning, when both should be zoned R6. Parcel IDs: 04-09962 and 04-04834. Glynn County Board of Commissioners, applicant. (D. A motion was made by Commissioner Taylor and seconded by Commissioner Callaway to approve ZM2453, ZM2465, ZM2477, and ZM2483. The motion carried unanimously.  Resolution #R-55-12

           

9.         ZM2477 Zoning Map Correction Two Way Fish Camp – Consider a request to make corrections to the Glynn County Zoning Map, as provided in Article XI, Section 1110. The corrections involve several rezoning cases at the Two Way Fish Camp to the east of Highway 17 on the South Altamaha River. These cases are: GC-10-69 which rezoned from CP (Conservation Preservation) to FA (Forest Agricultural); GC-15-85 which rezoned from FA (Forest Agriculture) to LC (Local Commercial) and; GC-36-87 which rezoned from FA (Forest Agriculture) and LC (Local Commercial) to PD-R, (Planned Development, Residential). These cases resulted in overlapping designations and zoning districts incorrectly depicted on the Zoning Map. Parcel IDs are: 02-00009; 02-000010; 03-16527; 03-11989; 02-00014, and; 02-00012. A motion was made by Commissioner Taylor and seconded by Commissioner Callaway to approve ZM2453, ZM2465, ZM2477, and ZM2483. The motion carried unanimously.  Resolution #R-56-12

 

10.       ZM2483 Zoning Map Correction 3590 U.S. Highway 17 S. – Consider a request to make a correction to the Glynn County Zoning Map, as provided in Article XI, Section 1110. The correction involves rezoning case GC-7-88 which changed the subject property from FA (Forest Agricultural) to LI (Light Industrial) in 1988. The property is located on the north side of Highway 17 between Southport Parkway and Buck Swamp Road and is incorrectly depicted as HC (Highway Commercial). Parcel ID: 03-11562. A motion was made by Commissioner Taylor and seconded by Commissioner Callaway to approve ZM2453, ZM2465, ZM2477, and ZM2483. The motion carried unanimously.  Resolution #R-57-12

 

CONSENT AGENDA – General Business

 

11.       Approved the minutes of the special called meetings held September 18, 2012, and October 16, 2012, as well as the minutes of the regular meeting held October 18, 2012, subject to any necessary corrections.  (C. Overstreet)

 

12.       Approve a Course Collaboration Agreement between Glynn County, the City of Brunswick, and the Savannah College of Art and Design (SCAD) for the Highway 17 Gateway Corridor design project. (C. Taylor) This item was removed from the agenda prior to the meeting.   

 

13.       Approved a bailment agreement with Roush CleanTech LLC for Glynn County to test drive an alternative fuel prototype vehicle at no cost to the County. (B. Rowell)  LINK

 

14.       Authorized the appropriate parties to sign the required forms and certifications for the Georgia Department of Transportation (GDOT) Transportation Enhancement (TE) Grant for the St. Simons Island Lighthouse Keepers House. The grant is being administered by the Coastal Georgia Historical Society Inc. but the County is the official recipient and therefore the appropriate party to execute the forms. Project No. 0010587. A motion was made by Commissioner Sublett and seconded by Commissioner Taylor to approve all items on the consent agenda with the exception of item 12, which was removed from the agenda prior to the meeting. The motion carried unanimously.

 

GENERAL BUSINESS

 

15.       Consider a request to adjust the Glynn County Pay Plan by 3% effective November 18, 2012; amend the FY 13 budget with funding to be provided by the applicable fund balances; award a 3% salary increase to employees in the pay plan effective December 6, 2012; and, reinstitute the annual merit increases effective July 1, 2013. A motion was made by Commissioner Taylor and seconded by Commissioner Hunt to approve a one-time COLA adjustment of 3% effective December 6, 2012, for eligible County employees, with consideration given to reinstituting merit raises in FY14, and to amend the FY13 budget with funding to be provided by the applicable fund balances. The motion carried unanimously.

 

 

EXECUTIVE SESSION

 

A motion was made by Commissioner Hunt and seconded by Commissioner Sublett to adjourn to executive session to discuss pending litigation.  The motion carried unanimously.

 

Back in Session

 

A motion was made by Commissioner Sublett and seconded by Commissioner Hunt to adjourn executive session and enter into regular session. The motion carried unanimously.

 

A motion was made by Commissioner Callaway and seconded by Commissioner Hunt to approve the minutes of the September 20, 2012, executive session. The motion carried unanimously.

 

There being no further business, the meeting was adjourned at 7:08 p.m.
