INVOCATION AND PLEDGE



Chairperson Tullos made a brief comment about the police incident last Friday, and commended the way the all police officers involved handled the situation. Chairperson Tullos also mentioned the three officers, Robert Harvey, Barry Moore, and David Westall, who where injured in the incident and reported they are all doing well.



1. APPROVAL OF MINUTES



Approve Minutes of Regular Meeting held Thursday, August 7, 1997.



Motion to approve, subject to corrections, by Commissioner Hardman, seconded by Commissioner Jerome Clark. Unanimously approved.



2. EMPLOYEE OF THE MONTH



Presentation of Plaque and $50 check to Joseph Lanham, Court Officer, Juvenile Court.



3. PROCLAMATIONS



Proclamation declaring August 24, 1997 through August 30, 1997 "Kiwanis Week". (F. Tullos)



Motion to approve by Commissioner Robertson, seconded by Commissioner Tommy Clark. Unanimously approved.



4. GEORGIA FORESTRY ANNUAL REPORT



Frank Sorrells, Forester, to present report.



Report received for informational purposes.



5. DELEGATIONS



Dr. Joe Iannicelli to discuss School Board Budget. (J. Hardman)



Statement received for informational purposes.



Mr. David Smith, Plant Manager of Hercules, made a statement in response to allegations made by Mr. Iannicelli regarding Mr. Smith's involvement in heading up a recent bond issue, and Hercules' alleged contamination of school property.



6. PUBLIC HEARINGS



A. Zoning

SUP-2-97



Request for a Special Use Permit in an R-12 One-Family Residential District to permit a mobile home as a Medical Hardship. Subject property consists of 1.73 acres, Lots 52A and 52B, Section "D", Addition 2, Glyndale Subdivision, having frontage on and located between Canal Street and Glyndale Circle, lying east of I-95; 5 feet from the southwest property line and 200 feet from the northwest property line. Property owned by Grady and Deidra Sapp and Clifford N. Martin.



The Commissioners heard from Ms. Dee Dee Sapp and Mr. Gene Sapp, grandparents of baby with medical hardship, and Diane Wilkes, therapist of baby, both of whom spoke in favor of request.



Mr. John Register, Mr. Danny Ramsey and Ann Robinson, neighbors of the Sapps, spoke in opposition to the rezoning.



Motion by Commissioner Strickland, seconded by Commissioner Dowdy, that the permit be granted if a single wide can obtained and as long as County strictly enforces time limits. Motion passed 5-2, Commissioner Hardman and Commissioner Jerome Clark opposed.



B. Alcoholic Beverage License



Consider issuance of 1997 Alcoholic Beverage License for Elliott's American Grill (formerly Damon's), 2463 Demere Road, St. Simons Island, Georgia. LICENSE FOR CONSUMPTION ON PREMISES OF DISTILLED SPIRITS, MALT BEVERAGES, AND WINE. SUNDAY SALES PERMITTED. (Occupation Tax)



Motion to approve by Commissioner Dowdy, seconded by Commissioner Robertson. Motion passed 6-1, Commissioner Tommy Clark opposed.



7. CONSENT AGENDA



General



A. Request Final Plat Approval - Gary L. Moore Court. Malcolm McKinnon Airport, located off Airport Road. (K. Flanagan)



B. Request authorization of acceptance of drainage easement, and quit claiming of existing easement in Belle Point East. (R. Richard)



Motion by Commissioner Strickland, seconded by Commissioner Jerome Clark, to approve Consent Agenda. Unanimously approved.



GENERAL BUSINESS



8. Consider appeal of Mr. and Mrs. G. C. Caye, Jr. of Tree Board denial of request. (L. Gilmour)



Motion to defer by Commissioner Robertson, seconded by Commissioner Dowdy, until later date after Commissioners have had opportunity to meet with Mr. Caye, per his request. Unanimously approved.



9. Consider request for a variance from the Glynn County Subdivision Regulations, to allow the subdividing of a two (2) acres tract on Chris Road. Variance being requested would allow the subject property to be split to create an additional lot on an unpaved County road that currently already serves the ten (10) lot maximum, this would create the 11th lot which requires paving of the road. James and Florine Toler, Property Owners; Don Hutchinson, Agent. Note: Chris Road scheduled to paved by the County in 1998. (K. Flanagan)



Motion to deny by Commissioner Robertson, seconded by Chairperson Tullos for discussion.



Motion and second withdrawn.



Motion by Commissioner Dowdy, seconded by Commissioner Jerome Clark, to send issue back to Planning Commission for them to make a decision and that the County Attorney be present at that meeting. Motion passed 5-2, Commissioner Hardman and Commissioner Robertson opposed.



10. Review of composting options in Glynn County. (L. Gilmour)



Motion by Commissioner Dowdy, seconded by Chairperson Tullos, to provide two drop off sites after closure and to bid out for services. Motion passed 6-1, Commissioner Strickland opposed.



COMMISSIONER URGENT AND EMERGENCY ITEMS



Commissioner Jerome Clark



1. One item of potential litigation for Executive Session.



Commissioner Dowdy



1. Clean and Beautiful has some money in the bank and would like to have it freed up so the new Clean and Beautiful Board can put it to use.



This item to be researched and brought up at next meeting.



Commissioner Robertson



1. Request stop sign and painted crossing bar at the intersection of Mallory Street at Butler Avenue in the Village.



Motion to approve by Commissioner Robertson, seconded by Commissioner Dowdy. Unanimously approved.



2. Request that County Surveyor install concrete monuments at East Beach Property, with funds coming from Discretionary Fund, not to exceed $920.



Motion to approve by Commissioner Strickland, seconded by Commissioner Robertson. Unanimously approved.



Commissioner Hardman



1. The Norfolk Southern Railroad was asked on July 30, 1997 to clean up debris left by logging companies at railroads. To date this has not been done.



2. On August 1, 1997 a letter was also written to Norfolk Southern regarding the continued and increased railroad traffic at the intersection of the railroad at Ballard. Would like to begin process of implementing a 5 minute Crossing Ordinance.



Both issues are to be addressed in pending meetings with the Railroad.



CHIEF OF POLICE ITEMS



None



COUNTY ATTORNEY ITEMS



1. Items of pending and potential litigation for Executive Session.



ADMINISTRATOR ITEMS



1. Judge Gilbert request authorization to apply for grant money for Victim's Assistance Program.



Motion to approve by Commissioner Robertson, seconded by Commissioner Dowdy. Unanimously approved.



2. Received bids for fuel tank replacement. The low bidder did not qualify. Request authorization to reject all bids and go back out for new bids.



Motion to approve by Commissioner Tommy Clark, seconded by Commissioner Jerome Clark. Unanimously approved.



3. Request award of bid for Arnold Road Drainage Improvements to low bidder, APAC, Inc. in the amount of $190,211.43.



Motion to approve by Commissioner Dowdy, seconded by Commissioner Robertson. Unanimously approved.



4. Request clarification on new prescription program approved by Board, on whether or not to allow more than one month's supply to be filled at one time.



Motion by Commissioner Hardman, seconded by Commissioner Dowdy, to allow up to 90 day's to be filled at one time for maintenance drugs. Unanimously approved.



EXECUTIVE SESSION



Motion by Commissioner Jerome Clark, seconded by Commissioner Hardman, to adjourn to Executive Session to discuss matters of pending and potential litigation and personnel. Unanimously approved.



BACK IN REGULAR SESSION



Motion by Commissioner Hardman, seconded by Commissioner Tommy Clark, to approve Executive Session Minutes of July 17, 1997 and August 7, 1997. Unanimously approved.
