4. PUBLIC HEARINGS



A. Zoning



(1) GC-21-97



Request to Rezone from Forest Agricultural to Planned Development, 19.76 acres located on the westerly corner of the U.S. Highway 17 and Andy Tostensen Road/Half Moon Road intersection; having frontage of 1,544.90 feet on the north side of US Highway 17 and approximately 325 feet on the west side of Andy Tostensen Road. Motion by Commissioner Dowdy, seconded by Commissioner Strickland, to approve Resolution No. R-41-97, which is on file and made a part of the permanent records in the Clerk's Office. Unanimously approved.



(2) GC-23-97



Request to Rezone from R-20 One-Family Residential to Forest Agricultural, 1.17 acres fronting 439.17 feet on the west side of Canal Road beginning 1,015 feet north of the Canal Road and Cate Road intersection. Property owned by Diversified Investments, Inc. (K. Flanagan)

Motion by Commissioner Hardman, seconded by Commissioner Dowdy, to approve Resolution No. R-42-97, which is on file and made a part of the permanent records in the Clerk's Office. Unanimously approved.



B. Abandonments



(1) Consider request to abandon an unopened portion of Benedict Road between Old Cypress Mill Road and Supr 25, Brunswick. Sawyer and Associates applicant.



Buzzy Ramsey spoke in opposition to the abandonment.



Motion by Commissioner Dowdy, seconded by Commissioner Hardman, to approve Resolution No. R-44-97, which is on file and made a part of the permanent records in the Clerk's Office. Motion passed 6-0-1. Commissioner Robertson abstained.



(2) Consider request to abandon an unopened portion of an unnamed alley between Lots 15 and 27, L. M. Kinstle Subdivision, Brunswick. Morningside of Brunswick, LP applicant.



Motion by Commissioner Tommy Clark, seconded by Commissioner Jerome Clark, to approve Resolution No. R-45-97, which is on file and made a part of the permanent records in the Clerk's Office. Motion passed 6-0-1. Commissioner Dowdy abstained.



C. Alcoholic Beverage License



(1) Consider issuance of 1997 Alcoholic Beverage License for Captain Morgan's Food Shop, 5090 Blythe Island Highway, Brunswick, Georgia 31525. LICENSE FOR PACKAGE SALES OF MALT BEVERAGES AND WINE. SUNDAY SALES PROHIBITED. (Occupation Tax)



Motion to approve by Commissioner Hardman, seconded by Commissioner Dowdy. Unanimously approved.



(2) Consider issuance of 1997 Alcoholic Beverage License for Germain Distribution, 102 Spaulding Court, Brunswick, Georgia 31520. LICENSE FOR WHOLESALE DISTRIBUTION OF WINE ONLY. SUNDAY SALES PROHIBITED. (Occupation Tax)



Motion to approve by Commissioner Jerome Clark, seconded by Commissioner Dowdy. Motion passed 6-1, Commissioner Tommy Clark opposed.



(3) Consider issuance of 1997 Alcoholic Beverage License for Lewis' Country Village, 7276 Blythe Island Highway, Brunswick, Georgia 31525. LICENSE FOR SALE ON PREMISES OF DISTILLED SPIRITS, WINE AND MALT BEVERAGES. SUNDAY SALES PROHIBITED. (Occupation Tax)



Motion to approve by Commissioner Hardman, seconded by Commissioner Strickland. Motion passed 6-1, Commissioner Tommy Clark opposed.



(4) Consider issuance of 1997 Alcoholic Beverage License for Village Package Store, 508 Ocean Boulevard, St. Simons Island, Georgia 31522. LICENSE FOR PACKAGE SALE OF DISTILLED SPIRITS, WINE AND MALT BEVERAGES. SUNDAY SALES PROHIBITED. (Occupation Tax)

Motion to approve by Commissioner Hardman, seconded by Commissioner Robertson. Motion passed 6-0-1, Commissioner Tommy Clark abstained.



5. CONSENT AGENDA



A. Finance Committee



(1) Recommend denial of a request by Mr. David Johns, District Manager, Union Camp Corporation, that $1,120.51 in landfill fees incurred to clean up illegal dumps sites be waived, but authorize one-half of the charges ($560.25) be paid with funds from the Road Division of the Public Works Department. (Vote: 3-0-0)



(2) Recommend exercising the 1st year option extension of Psychiatry/ Psychology services agreement with Gateway Center for Human Development for the Detention Center at a flat rate of $1,000.00 per month. (Vote: 3-0-0)

(3) Recommend awarding a bid to MCBA, Inc., Huntsville, AL, in the amount of $83,908.00, to purchase computer hardware (RS600, F-50) and software to support all departments and authorize staff to bid for the payment through a government leasing program. (Vote: 3-0-0)



Motion by Commissioner Dowdy, seconded by Commissioner Jerome Clark, to approve and to finance the Lease/Purchase through the low bidder, SunTrust Bank, Brunswick. Unanimously approved.



(4) Recommend authorizing staff to issue an IFB for Janitorial Services for Demere Annex. (Vote: 3-0-0)



(5) Recommend authorizing staff to issue an RFP to obtain consulting services to determine the cost associated with a small scale public transit system for the Brunswick Area Transportation Study (BATS) with funding by a $20,000.00 grant. (Vote: 3-0-0)



Motion to deny by Commissioner Hardman, seconded by Commissioner Dowdy. Motion passed 5-2. Chairperson Tullos and Commissioner Robertson opposed.



(6) Recommend all bids to purchase windows for the State Patrol Building be rejected and authorize staff to rebid. (Vote: 3-0-0)



(7) Consider awarding the bid for the purchase of budgeted items to the following vendors whose bid was the low bid, within the budget amount and complied with all the bid specifications:



(a) Recommend the bid to purchase Glock Pistols for the Police Department be awarded to the sole bidder, Smyrna Police District, Smyrna, GA, in the amount of $60,423.00, less $212.00 for each pistol traded-in. (Vote: 3-0-0)



(b) Recommend the bid to purchase two Gator 6 X 4 Utility Vehicles for the Public Works Department be awarded to Ocmulgee Tractor Company, Hazelhurst, GA, in the amount of $15,708.00, with funding to come from the department's Management Incentive Bonus. (Vote: 3-0-0)



(c) Recommend the bid contract to pave 7.09 miles of County roads be awarded to the low bidder, Douglas Asphalt Company, Inc., Douglas, GA, in the amount of $1,129,664.50. (Vote: 3-0-0)



(d) Recommend the bid to purchase chemicals for Water & Sewer Department be awarded to the low bidder, Allied Universal Corporation, Miami, FL, in the amount of $5,320.80. (Vote: 3-0-0)



(8) Recommend authorizing a change order in the amount of $5,195.03 to the contract with Collins Construction Services, Inc., Savannah, GA, on the renovation to the W. Harold Pate Courthouse Annex Building. (Vote: 3-0-0)



Motion by Commissioner Tommy Clark, seconded by Commissioner Strickland, to approve change order, with the exception of the Ponderosa pine, to await explanation from Architect on that item. Unanimously approved.



(9) Recommend authorizing staff to conduct the 1997 Public Auction for the sale of surplus County property on Saturday, October 18, 1997. (Vote: 3-0-0)



(10) Recommend renewing three insurance policies with an effective date of July 1, 1997. (Vote: 3-0-0)



B. Personnel Committee



(1) Request authorization payment of up to 400 hours of accrued annual leave to widow of Homer Boyd, due to his sudden death. (Vote: 2-0-0)



(2) Non-County informational packages provided through County payroll shall only be for organizations approved by the Board for payroll deductions. (Vote: 2-0-0)



(3) Amend the pay ranges for the following positions:

(2) Request Final Plat Approval - Ridgewood Plantation Subdivision, Phase II - An 18 lot subdivision located on the south side of Jessica Lane off of Perry Lane Road. (K. Flanagan)



(3) Request Final Plat Approval - Little Oaks Subdivision - A 12 lot subdivision located on the south side of Buck Swamp Road. (K. Flanagan)

(12) Request authorization to waive fee for use of Selden Park for dances sponsored by the Brunswick/Glynn Law Enforcement Explorers Post #268. (L. Gilmour)



Motion by Commissioner Robertson, seconded by Commissioner Dowdy, to approved Consent Agenda, with the exceptions of Items 5A(3), 5A(5), 5A(8), and 5B(3) which were pulled and voted on individually. Unanimously approved.



6. ITEMS REFERRED FROM FINANCE COMMITTEE



A. Deferred to the full Commission action to be taken on authorizing an amendment to the Code of Ordinances to impose a license fee for EMS prime providers. (Vote: 3-0-0)



Motion by Commissioner Dowdy, seconded by Commissioner Hardman, to ask local legislature in to pursue legalizing the imposition of this fee. Unanimously approved.



B. Deferred to the full Commission a request that the Board of Commissioners appoint a County Commissioner as the Board's representative for the County Auction to be held Saturday, October 18, 1997. (Vote: 3-0-0)



Motion by Commissioner Tommy Clark, seconded by Commissioner Robertson, to appoint Commissioner Dowdy as representative and authorize him to make small changes as necessary. Unanimously approved.



7. ITEMS REFERRED FROM PERSONNEL COMMITTEE



Amend the Employee's Health Insurance Plan relative to prescription drugs to the following:



(1) The $150.00 deductible per person is eliminated.



(2) Per each prescription covered by the Plan, the employee will pay the first $8.00 for generic drugs, and $15.00 for brand name drugs.



(3) No payroll deduction will be provided for prescriptions.



(4) Only members of the Employee Health Insurance Plan can participate in this program.



This is effective September 1, 1997. (Vote: 2-0-0)



Motion to approve by Commissioner Dowdy, seconded by Commissioner Hardman, with the amendment that where only name brands are available, the $8 charge be applicable. Unanimously approved.

Motion by Commissioner Tommy Clark, seconded by Commissioner Jerome Clark to reappoint Chuck Chapman. Unanimously approved.

Motion to approve by Commissioner Tommy Clark, seconded by Commissioner Jerome Clark. Unanimously approved.



GENERAL BUSINESS



9. Dr. Joe Iannicelli to discuss School Board Budget. (J. Hardman)



Dr. Iannicelli asked to be deferred until the next meeting.



10. Citizens to discuss Barnes Plantation Pump. (G. Robertson)



The Commission heard from Mildred Huey Wilcox, Alicia Lyons, and Nancy Thomason who spoke in opposition to the pump station.



11. Consider request for Business License for Dink's Barber Shop. (F. Tullos/J. Hardman)



The Commission heard from Pat Cody and Barbara Dinkins, and Lonnie Newbern regarding their situation. It was suggested that they apply to Planning and Zoning for rezoning.



12. Consider request from Tony & Sandi Dobbs to place fence on County right of way. (K. Flanagan)



Motion by Commissioner Hardman, seconded by Commissioner Strickland, to approve a revocable license. Unanimously approved.



13. Consider appeal of Plumbing Advisory/appeals Board for use of CPVC water distribution piping, in lieu of specified copper system. (K. Flanagan)



Motion by Commissioner Dowdy, seconded by Commissioner Strickland, to amend the ordinance to approve the use of CPVC pipe. Ordinance No. O-1997-19. Unanimously approved.



POINT OF PRIVILEGE



Request authorization to approve lease between Airport and Ernie Knight, subject to County Attorney approval.



Motion to approve by Commissioner Hardman, seconded by Commissioner Dowdy. Unanimously approved.



14. Discussion of compensation paid to County by State for sale of causeway stickers. (J. Hardman)



Staff was directed to look into increasing compensation paid by state.



15. Consider available options on disposition of Knight Street Property. (Carried forward from July 17, 1997 Meeting) (G. Moore)



Motion by Commissioner Dowdy, seconded by Commissioner Jerome Clark, to study the value, and various uses, and possible rezoning for the best possible price the County can get. Unanimously approved.



Motion by Commissioner Dowdy, seconded by Commissioner Jerome Clark, to advise trespassers to vacate land and post sign prohibiting further trespassing. Unanimously approved.



16. Discussion of German Village Report. (Carried forward from June 19, 1997 Meeting) (K. Flanagan/G. Robertson)



A Committee consisting of Keith Flanagan, Gary Moore, Commissioner Hardman and Commissioner Robertson was directed to look into this situation and come back recommendations.



17. Request authorization of following from Coastal Georgia Land Trust:



A. Resolution adopting the Gateway to Coastal Georgia Master Plan as it pertains to Glynn County.



B. Resolution designation a demonstration project in Glynn County.



C. Request matching contribution from Glynn County for Coastal Georgia Greenway. (L. Gilmour)



Motion by Commissioner Dowdy, seconded by Commissioner Jerome Clark, to defer until further information can be obtained. Unanimously approved.



18. Hearing Officer Report on Adverse Action of William Piper, Engineering Manager, Water and Sewer Department. (B. Rowell)



Mr. Piper's attorney, Eugene Highsmith presented his appeal.



Motion by Commissioner Robertson, seconded by Commissioner Tommy Clark, to adjourn to Executive Session to discuss this matter. Unanimously approved.



BACK IN OPEN SESSION



Motion by Commissioner Tommy Clark, seconded by Commissioner Dowdy, to give Mr. Piper ten days off without pay, to give a written reprimand, to reinstate his probationary period for six months, and to require he and Mr. Benson attend counseling through the Employee Assistance Program. Unanimously approved. Commissioner Robertson out of the room.



COMMUNITY DEVELOPMENT



Request adoption of Resolution No. R-43-97, which is on file and made a part of the permanent records in the Clerk's Office, authorizing resubmittal of the Comprehensive plan.



Motion to approve by Commissioner Hardman, seconded by Commissioner Strickland. Motion passed 6-0-1, Commissioner Robertson abstained.

2. Request authorization to award bid for repairs to second floor roof the New Courthouse to the sole bidder, Collins Construction, Savannah, GA, in the amount of $145,505.00, to be paid from SPLOST II funds..

3. Request authorization to award bid for installation of Effluent Line at I-95/US 17 Wastewater Treatment Plant, to low bidder, AquaSouth Construction, Savannah, GA, in the amount of $52,760.00.
