Approve Minutes of Regular Meeting held November 5, 1998.



Motion to approve, subject to any necessary corrections, by Commissioner Tommy Clark, seconded by Commissioner Dowdy. Unanimously approved.



2. EMPLOYEE OF THE MONTH



Presentation of Plaque and $50 check to Robert Harrell, Supervisor, I Public Works Department.

3. PUBLIC HEARINGS



A. Abandonment



Consider application for abandonment of Charles Street, Blythe Island. Ms. Marie L. Thomas applicant. (J. Bruner)



After brief discussion, motion by Commissioner Hardman, seconded by Commissioner Tommy Clark to approve the above application for abandonment of Charles Street, subject to the County retaining a 390' portion of the street adjacent to the County Park for access, buffer, drainage and utility purposes. Unanimously approved as resolution #R-67-98 with original filed per resolution #R-06-98.

B. Alcoholic Beverage License

1. Consider issuance of a 1998 & 1999 Alcoholic Beverage License to Captain Morgan's Food Shop, 5090 Blythe Island Highway, Brunswick, GA. LICENSE TO SELL MALT BEVERAGES ONLY NOT FOR CONSUMPTION ON PREMISES. NO SUNDAY SALES (Occupational Tax )



Motion to approve by Commissioner Strickland, seconded by Commissioner Jerome Clark. Motion passes with a vote of 6-0-1 with Commissioner Tommy Clark abstaining.



2. Consider issuance of a 1999 Alcoholic Beverage License to Carter's, 4411 New Jesup Highway, Brunswick, GA. LICENSE TO SELL MALT BEVERAGES ONLY NOT FOR CONSUMPTION ON PREMISES. NO SUNDAY SALES. (Occupational Tax)

Motion to approve by Commissioner Jerome Clark, seconded by Commissioner Hardman. Motion passes with a vote of 6-0-1 with Commissioner Tommy Clark abstaining.



7. Consider renewal of 1999 Alcoholic Beverage Licenses. (Occupational Tax) See attached listing.



Motion to approve by Commissioner Hardman, seconded by Commissioner Jerome Clark. Motion passes with a vote of 6-0-1 with Commissioner Tommy Clark abstaining.

4. CONSENT AGENDA



General

A. Authorize establishment of a separate interest bearing account for Drug Court Revenue. (F. Tullos)



B. Resolution authorizing Chairman to accept and execute all documents for the Coastal Impact Program grants awarded to the County. (L. Gilmour)



Approved as resolution #R-68-98 with original filed per resolution #R-06-98.



C. Authorize attendance to the ACCG 1999 Legislative Conference, February 2nd and 3rd, 1999 in Atlanta, Georgia. (L. Gilmour)



Motion by Commissioner Dowdy, seconded by Commissioner Jerome Clark to approved Consent Agenda items 4 (B) and 4 (C). Unanimously approved.

4. CONSENT AGENDA



General

A. Authorize establishment of a separate interest bearing account for Drug Court Revenue. (F. Tullos)

Motion by Commissioner Hardman, seconded by Commissioner Dowdy to insure that the drug court fund idle monies are invested per the County's "sweep account" procedures and that the current balance of the Drug Abuse, Training, and Education Fund is appropriated to the Drug Court Fund. Unanimously approved.



GENERAL BUSINESS



5. Consider authorizing Chairman to write a letter to the Insurance Commissioner requesting relief from insurers who exclude homes with unenclosed foundations when the home is required to be elevated by FEMA. (J. Hardman)



After brief discussion, motion by Commissioner Hardman, seconded by Commissioner Jerome Clark authorizing the Chairman to write a letter to the Insurance Commissioner regarding the above item. Unanimously approved.



6. Consider request from Jim Walter Homes to move a house located at 664 Scranton Road, Brunswick, GA. (E. Carter)

After brief discussion, motion to approve by Commissioner Tommy Clark, seconded by Commissioner Strickland. Unanimously approved.



7. Cost analysis regarding the installation of a traffic signal at Old Jesup Road, Cate Road and Crispen Blvd intersection. (J. Clark)



After brief discussion, motion by Commissioner Jerome Clark, seconded by Commissioner Dowdy to proceed with the installation of a traffic signal at this intersection. Unanimously approved.

8. Review cost impact relative to depth modifications of fountain located at Glynn County Courthouse courtyard. (L. Gilmour)



No action taken at this time. Item deferred for purpose of receiving a cost estimate.



9. Consider awarding the bid for Emergency Generators for Environmental Quality Department's Water & Sewer Division. (K. Flanagan) This item deferred from the November 5, 1998 BOC Meeting.



Motion by Commissioner Hardman, seconded by Commissioner Robertson to defer this item to the December 3, 1998 BOC meeting. Unanimously approved.



10. Consider an amendment to Sections 1001, 1008, and 1009 of the Zoning Ordinance to:



After brief discussion, motion by Commissioner Robertson, seconded by Commissioner Dowdy to send the above proposed amendments to the Planning Commission for their recommendation. Unanimously approved as ordinance amendment #0-1998-19 with original filed per resolution #R-06-98.



After further discussion, motion by Commissioner Dowdy, seconded by Commissioner Robertson, that the Zoning Appeal Board appear before the Glynn County Board of Commissioner to show just cause why they should not be removed for failure to perform their duties. Motion failed with a vote of 3-4 with Commissioner Dowdy, Commissioner Robertson and Commissioner Tommy Clark in favor, and Chairman Tullos, Commissioner Jerome Clark, Commissioner Hardman and Commissioner Strickland opposed.

11. Consider proposal to add additional members to the Planning Commission. (D. Dowdy)



After brief presentation, motion by Commissioner Dowdy to send to the Planning Commission, for their recommendation, a proposal to add additional members to the Planning Commission. Seconded by Chairperson Tullos for discussion.



After further discussion, motion by Commissioner Strickland, seconded by Commissioner Hardman to defer this item to the Board of Commissioners December 3, 1998 meeting. Vote 6-0-1 with Commissioner Dowdy abstaining.



12. Consider an agreement relative to Barnes Plantation. (G. Moore)



After brief discussion motion by Commissioner Dowdy, seconded by Commissioner Jerome Clark to follow the County Attorney's recommendation regarding a drainage improvement agreement, authorize the Chairman to sign said agreement, subject to approval as to form by the County Attorney and to employ Mr. Tom Lee to do the condemnation work with the entire cost paid by the developer. Motion passes with a vote of 5-0-1 with Commissioner Robertson abstaining. (Chairman Tullos out of the room)



13. Meter changes for "irrigation only" meters. (L. Gilmour) This item deferred from the November 5, 1998 BOC Meeting.



Motion by Commissioner Hardman, seconded by Commissioner Jerome Clark to defer this item to the Board of Commissioners December 3, 1998 meeting. Unanimously approved. The motion to defer this item was made earlier in the meeting with Chairman Tullos present.



COMMISSIONER URGENT AND EMERGENCY ITEMS



Commissioner Dowdy



Signs for Adopt a Highway program.



Staff directed to prepare signs for organizations on St. Simons and the mainland that participate in the Adopt a Highway program.



Commissioner Tommy Clark - None



Commissioner Jerome Clark



Concerns regarding signs indicating the location of the entrances to Satilla Marsh school and Needwood Middle School and request DOT install signs showing the turn off location/entrances to each school.



Commissioner Dowdy brought to the Board's attention additional traffic problems at South Palm Drive and the request of the residents of the area for the erection of "Slow Children Playing signs and a petition regarding a street light with the lighting request handled by staff.

Motion by Commissioner Dowdy, seconded by Commissioner Tommy Clark to make the request to GA/DOT regarding the recommended signage at Satilla Marsh School and Needwood Middle School and the installation of "Slow Children Playing" signs in the South Palm Drive area. Motion carries with a vote of 6-0. (Commissioner Tullos out of the room)



Commissioner Strickland



Concerns regarding non County ambulance service and billing.



Motion by Commissioner Strickland, seconded by Commissioner Hardman staff to prepare a position statement for presentation to the County's legislative delegation to amend or clarify the County's oversight control relative to E-911 EMS responders. Motion carries with a vote of 6-0. (Chairman Tullos out of the room)



Commissioner Hardman - None



Commissioner Robertson



1. Request authorization to file grant application for third part of DNR grant in the amount of $25,000.00 for Massengale Park improvements.



After brief discussion motion by Commissioner Robertson, seconded by Commissioner Hardman to approve the filing of the grant application. Motion carries with a vote of 6-0. (Chairman Tullos out of the room)



2. Request from Dunbar Creek Plantation and Shaw's Bounty Homeowners Associations relative to including their associations street lights in the County's preferential municipal rate. County to be reimbursed the actual cost plus five (5%).



Motion to approve Commissioner Hardman, seconded by Commissioner Jerome Clark. Motion carries with a vote of 6-0. (Chairman Tullos out of the room.)



3. Consider agreement to form a committee relative to establish an emergency program for rescuing swimmers in trouble off St. Simons Island beaches, to meet the first week in December and consist of the following persons:

Chief Johnson, Fire Department

Commissioner Gerry Robertson

Kenneth Deen, Rescue Squad Representative

CHIEF OF POLICE ITEMS



1. "No Parking" signs and fence location at St. Simons Island Farmers Market.

For informational purposes only. No action required at this time.



2. Consider request from First Georgia Bank to block off a portion of street located near Epworth Marina and American Legion Post and Hamilton Road.



After brief discussion motion to approve by Commissioner Strickland, seconded by Commissioner Jerome Clark. Motion carries with a vote of 6-0. (Chairman Tullos out of the room)



COUNTY ATTORNEY ITEMS



1. Consider ordinance amendments revising staggered term process for advisory committees.



After brief discussion motion by Commissioner Dowdy, seconded by Commissioner Hardman to approve the County Attorney's recommendation regarding the ordinance amendments relative to advisory committee terms. Motion carries with a vote of 6-0. (Chairman Tullos out of the room) Approved as ordinance amendments #0-1998-20, #0-1998-21 and #0-1998-22 with original filed per resolution #R-06-98.



2. Item of pending/potential litigation for discussion in Executive Session.



ADMINISTRATOR ITEMS



1. Authorize the County to make application to initiate a re-zoning change of two (2) PUD's located of GA Highway 303 and Anchor Drive, Wagoneer Trucking and Clayton Homes relative to neighborhood buffer protection.



Motion to approve Commissioner Hardman, seconded by Commissioner Dowdy. Motion carries with a vote of 6-0. (Chairman Tullos out of the room)

2. Authorize Chairman to sign the Declaration of Use and Deed Notification, as required for closure of the Cate Road Landfill.



Motion to approve Commissioner Dowdy, seconded by Commissioner Jerome Clark. Motion carries with a vote of 6-0. (Chairman Tullos out of the room)

3. Consider authorization to apply for the following grants:



(A) Apply, through the consultant Bron Cleveland, for Phase II of the Coast Guard Station improvements.



(B) Apply for recreation trails grant for Altamaha Park.



Motion to approve Commissioner Dowdy, seconded by Commissioner Jerome Clark. Motion carries with a vote of 6-0. (Chairman Tullos out of the room) as resolution #R-69-98 with original filed per resolution #R-06-98.



4. Consider adding Baldwin Park Improvements request to the County's Unfunded Capital Project Request list.

Motion by Commissioner Hardman, seconded by Commissioner Jerome Clark to follow the County Administrators recommendation. Motion carries with a vote of 6-0. (Chairman Tullos out of the room)



5. Request authorization to reject bids for T 1 Line computer tie-ins.



Motion by Commissioner Dowdy, seconded by Commissioner Jerome Clark to reject bids. Motion carries with a vote of 6-0. (Chairman Tullos out of the room)





6. Consider request to use Coastal Georgia Regional Development Center to begin immediately the application process for the FEMA Project Impact Grant Program, due to the short submittal deadline of December 3, 1998.



Motion to approve Commissioner Hardman, seconded by Commissioner Dowdy. Motion carries with a vote of 5-1-1 with Commissioner Robertson opposed and Chairman Tullos abstaining.



7. Item regarding land acquisition for discussion in Executive Session.



Motion by Commissioner Dowdy, seconded by Commissioner Jerome Clark to adjourn to Executive Session for the purpose of discussing, pending/potential litigation and land acquisition. Unanimously approved.



Back in Regular Session



Motion by Commissioner Hardman, seconded by Commissioner Jerome Clark to accept the County Attorney's recommendation regarding pending/potential litigation. Unanimously approved.
