INVOCATION AND PLEDGE



1. APPROVAL OF MINUTES



Approve Minutes of Regular Meeting held Thursday, December 18, 1997.



Motion to approve, subject to corrections, by Commissioner Dowdy, seconded by Commissioner Hardman. Unanimously approved.



2. EMPLOYEE OF THE MONTH



Presentation of Plaque and $50 check to Corporal Ellen Wood, Glynn County Sheriff's Departments/Jail Administration.

3. PROCLAMATION



A. Adoption of Proclamation honoring Dr. Martin Luther King, Jr. (F. Tullos)



Motion to approve by Commissioner Jerome Clark, seconded by Commissioner Dowdy. Unanimously approved.



B. Adoption of Proclamation honoring Cynthia McKinley.



Motion to approve by Commissioner Dowdy seconded by Commissioner Tommy Clark. Unanimously approved.



4. PUBLIC HEARINGS



A. Zoning



(1) GC-35-97

Request to Rezone from Forest Agricultural to General Residential a Portion of Brunswick-Altamaha Canal consisting of 1.104 acres, located north of other properties owned by Tharion Pittman fronting on Walker Road, south and east of the Brunswick-Altamaha Canal (portion owned by Glynn County and lying north of Emanuel Missionary Baptist Church), and west of Lots 3 & 4 of Canal Landing Subdivision. Property owned by Tharion Pittman. (R. Milburn)



It is noted that staff recommends the rezoning with the exception of a 14,324 square foot easement on the Altamaha Canal, which was approved by the County Commission, it is understood that any improvements on easement are subject to removal should the County need access to easement.



Motion to approve by Commissioner Hardman, seconded by Commissioner Dowdy. Motion passed 6-1, Commissioner Robertson opposed.



(2) GC-2-97 A



Consider Amending the Glynn County Zoning Ordinance, Section 302. Definitions, to add the following definitions - Productive Marsh and Estuarine Area. (R. Milburn)



Motion to approve by Commissioner Dowdy, seconded by Commissioner Robertson. Motion failed 3-2-2. Commissioners Tullos, Robertson and Jerome Clark voting in favor of. Commissioners Dowdy and Strickland opposed. Commissioners Hardman and Tommy Clark abstained.



(3) GC-2-97 C



Consider Amending the Glynn County Zoning Ordinance, Article VIII, Sections 803.5.3 and 806 Regarding Fluttering Ribbons in Commercial Districts; and/or Consider Referring the matter back to the Glynn County Planning Commission. (R. Milburn) (Applicant, Board of Commissioners, Request referred back to Planning Commission)



(4) GC-2-97 D



Consider Amending the Glynn County Zoning Ordinance, Sections 302, 502, 617, 705 and 709 Regarding Height Requirements; and/or Consider Referring the matter back to the Glynn County Planning Commission. (R. Milburn) (Applicant, Board of Commissioners, Request referred back to Planning Commission)



Motion by Commissioner Hardman, seconded by Commissioner Dowdy, to send GC-2-97C and GC-2-97D back to Planning Commission, with the understanding that the Planning Commission will review the tape of this meeting to understand the full intent of the Commission. Unanimously approved.



C. Abandonments

Consider Application for Abandonment of a Portion of an Unused Cul-de-sac, Lot 13, Key Circle Drive, Brunswick, GA. Bobby Ellis applicant. (J. Bruner)



Mr. Neal Sutton spoke in favor of the application.



Motion to approve by Commissioner Strickland, seconded by Commissioner Jerome Clark. Unanimously approved.



D. Alcoholic Beverage License



(1) Consider issuance of 1998 Alcoholic Beverage License for Barbara Jean's, 214 Mallory Street, St. Simons Island, GA. LICENSE FOR SALE ON PREMISES DISTILLED SPIRITS, MALT BEVERAGES AND WINE. SUNDAY SALES PERMITTED. (Occupation Tax)



Motion to approve by Commissioner Strickland, seconded by Commissioner Jerome Clark. Motion to approve by 5-0-2. Commissioner Hardman and Commissioner Tommy Clark abstained.



(2) Consider issuance of 1998 Alcoholic Beverage License for Holiday Inn, 5252 New Jesup Highway, Brunswick, GA. LICENSE FOR SALE ON PREMISES DISTILLED SPIRITS, MALT BEVERAGES AND WINE. SUNDAY SALES PERMITTED. (Occupation Tax)



Motion to approve by Commissioner Strickland, seconded by Commissioner Jerome Clark. Motion passed 6-0-1, Commissioner Tommy Clark abstained.



5. APPOINTMENTS



A. Casino Advisory Board



Motion by Commissioner Robertson, seconded by Commissioner Dowdy, to appoint Harry Aiken to the District 2 appointment. Unanimously approved.



Motion by Commissioner Hardman, seconded by Commissioner Dowdy, to appoint Don Hogan to the District 4 appointment. Unanimously approved.



Motion by Commissioner Strickland, seconded by Commissioner Hardman to appoint Jane Segerberg to the District 3 appointment. Unanimously approved.



Motion by Chairperson Tullos, seconded by Commissioner Jerome Clark to appoint Mike Tenent to the At Large Post 1 appointment. Unanimously approved.



B. Board of Tax Assessors

Motion by Commissioner Dowdy, seconded by Commissioner Hardman, to change the appointment term for Tax Assessors to 4 years, with one of the appointments made tonight being for 2 years initially, then 4 years thereafter. Unanimously approved.



Motion by Commissioner Strickland, seconded by Commissioner Dowdy to reappoint Kevin Keller as the District 3 appointment for 4 years. Unanimously approved.



Motion by Commissioner Hardman, seconded by Commissioner Dowdy, to reappoint William Wright as the District 4 appointment for 2 years. Unanimously approved.



Motion by Commissioner Jerome Clark, seconded by Commissioner Strickland, to reappoint Eugene Roberts as the District 5 appointment for 4 years. Unanimously approved.



6. CONSENT AGENDA



General

A. Consider request from Ms. Nancy A. Shirah for Commission support in having the Bridge on I-95 between Exits 9 and 10 named after her son, Marshall Brandon Shirah, who was killed in a construction accident while working on the bridge. (T. Clark)



Motion to approve by Commissioner Hardman, seconded by Commissioner Jerome Clark. Unanimously approved.



B. Consider request from Ms. Gail Parker, whose son is hearing impaired, to have "Deaf Child" sign placed at entrance of A-1 Carpet Trailer Park to deter speeders. (R. Strickland)



C. Consider request for Piping Petition for Mr. William R. Bristow. (J. Bruner)



D. Approval of Recreation Department fees. (W. Davis)

Motion to approve by Commissioner Robertson, seconded by Commissioner Hardman. Unanimously approved.



E. Request Final Plat Approval - Rainwood Development - A six (6) lot subdivision located on the west side of Canal Road just north of the Glass Circle intersection. The development is served by a private well and water system and private sewer. Sewer lines will tie into the County mainland system. (D. Newbern)



Motion by by Commissioner Hardman, seconded by Commissioner Jerome Clark, to approve Items 6B,C, and D. Unanimously approved.



GENERAL BUSINESS



7. Consider request from Dr. C. M. Lara for revocable permit to place deck and a portion of a privacy fence on County right of way. (E. Carter)



Motion to approve by Commissioner Jerome Clark, seconded by Commissioner Tommy Clark. Motion passed 6-1, Commissioner Robertson opposed.



8. Adoption of an Ordinance to Amend the Code of Ordinances to restrict the distance between licensed retail package liquor locations. (L. Gilmour)



Motion to approve by Commissioner Dowdy, seconded by Commissioner Tommy Clark. Unanimously approved.



9. Request authorization for sewer repairs in alley behind Gisco's Seafood. (K. Flanagan)



Motion by Commissioner Robertson, seconded by Commissioner Hardman, to award bid for sewer repairs to H. Robinson Co., Inc. in the amount of $27,125.00. Unanimously approved.



10. Approval of a Resolution establishing the qualifying fees of certain County offices for 1998 primary and general elections per O.C.G.A. 21-2-131. (L. Gilmour)



Motion to approve by Commissioner Dowdy, seconded by Commissioner Strickland. Unanimously approved.



11. Hearing Officer's Report on Ricky Potter adverse action. (R. Rowell)



Motion by Commissioner Dowdy, seconded by Commissioner Tommy Clark, to adjourn to Executive Session for further discussion. Unanimously approved.



Motion by Commissioner Dowdy, seconded by Commissioner Tommy Clark, to uphold the Hearing Officers decision of dismissal. Unanimously approved.



Motion by Commissioner Dowdy, seconded by Commissioner Tommy Clark, to not withhold COBRA benefits. Unanimously approved.



12. Hearing Officer's Report on Gregory Griffin adverse action. (L. Gilmour)



This item deferred until the February 5, 1998 meeting, at which time Mr. Griffin's attorney can be present.



COMMISSIONER URGENT AND EMERGENCY ITEMS



Commissioner Hardman



1. Approve in concept only an ordinance requiring 911 ambulance providers to pay over the County on a monthly basis lease charges equal to essentially 1/8 of 1/3 of the cost of 911 at an 11% lease rate for the cost of equipment, maintenance, salaries, benefits, expenses per ambulance zone. Additionally, 911 ambulance providers bill on behalf of the County and attempt to collect and remit to the County along with the ambulance bills a minimum fee of $150.00 per call when a rescue truck from the Glynn County Fire Department is used for extraction purposes. Ambulance providers are to name Glynn County on their general liability and professional liability insurance policies and name Glynn County as an additional insured and carry $1,000,000.00 worth of liability.

1. Contract regarding consulting services for the 800 MHz Communications



Motion by Commissioner Dowdy seconded by Commissioner Tommy Clark, County Attorney is to notify contractor that by Friday week contractor must indicate their acceptance of the terms of the contract as proposed to them and that their failure to do so, by that time, will result in the revocation of that offer to them and will immediately rebid that contract. Unanimously approved.



Chairperson Tullos



1. Resolution regarding Floridan Aquifer



Motion to approve by Commissioner Hardman seconded by Commissioner Dowdy. Unanimously approved.



2. Discussion of employee hearings regarding procedures for Employee Adverse Action Hearings and Appeals.



3. City of Brunswick, Glynn County Board of Commissioners and Local Legislative Delegation to meet Thursday, January 22, 1998 at the Holiday Inn at I-95 & 341 at 6:30 PM.



CHIEF OF POLICE ITEMS



1. Notification from Region IX EMS of Coastal EMS's removal from ambulance service. The Glynn County Fire Department is now the sole provider of ambulance service for the region.



.COUNTY ATTORNEY ITEMS - 3 Items



1. Request local legislative delegation to introduce legislation to the General Assembly authorizing the Glynn County Board of Commissioners to impose a levy or charge on those E-911 care providers who receive their calls from the E-911 system so they can help the taxpayers support that system.



Motion to approve by Commissioner Hardman seconded by Commissioner Strickland. Unanimously approved.



2. Request local legislative delegation to introduce legislation to the General Assembly that any control interest of a piece of property that is maintained by a government entity and a lease of that nature would not have the effect of making it non-taxable.



Motion to approve by Commissioner Tommy Clark, seconded by Commissioner Jerome Clark. Unanimously approved.

3. Request local legislative delegation to introduce legislation to the General Assembly that water withdrawal permits would not be issued to private entities alone. They would only be issued to governmental bodies such as the Glynn County Board of Commissioners.





Motion to approve by Commissioner Dowdy, seconded by Commissioner Jerome Clark. Unanimously approved.



ADMINISTRATOR ITEMS



1. Assignment of contract with Container Corporation of Carolina to Southland.



Motion to approve by Commissioner Strickland, seconded by Commissioner Jerome Clark . Unanimously approved.



2. Request from Coast Guard to tie up at St. Simons Island Pier.



Motion to approve by Commissioner Dowdy, seconded by Commissioner Strickland. Unanimously approved.



3. Presentation of ongoing projects from Mr. Keith Flanagan.



a. Accept right-of-way contract from developer for Altama Connector project.



b. Request forms from GA/DOT requesting a County contract for assistance of expenses associated with the construction of two of twelve foot lanes and the construction of a head wall, retaining wall as required at the intersection of the spur.



c. Authorize Right-of-Way Certification for Altama Connector project.



d. Authorize the Chairman to sign a contract with property owner, subject to approval by the County Attorney, to do these three things.

Motion to approve by Commissioner Dowdy, seconded by Commissioner Strickland . Unanimously approved.



e. Request from Altama Connector project property owner for authorization for a revocable permit for landscaping and irrigation on the right-of-way accepted by the County.



Motion to approve by Commissioner Hardman, Commissioner Strickland. Unanimously approved.



4. Request from Coastal Georgia Community College regarding use of County wood chipper at no cost.



Motion to approve by Commissioner Hardman, seconded by Commissioner Jerome Clark . Unanimously approved.



5. Authorize amendment to SPLOST III funding capital authorized for Recreation Department to add public restrooms on the south end of the Old Casino, Neptune Park.



Motion to approve by Commissioner Hardman, seconded by Commissioner Strickland. Unanimously approved.



6. Recommend designating replacement of the roof of New Courthouse facility with a pitched roof as phase II of the repair work and proceed with use of breathable sealant for brick and caulking



Motion by Commissioner Hardman, seconded by Commissioner Dowdy to approve the use of a breathable sealant for brick and caulking at New Courthouse facility. Unanimously approved.



7. Recommend authorization to award of bid for replacement vehicle Juvenile Court to Jerry Brown Chevrolet in the amount of $14,410.00 per State contract.



Motion to approve by Commissioner Strickland, seconded by Commissioner Jerome Clark . Unanimously approved.



Motion by Commissioner Hardman, seconded by Commissioner Tommy Clark to adjourn to Executive session for discussion of matters regarding personnel and potential litigation. Unanimously approved.
